Please read our terms carefully

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of healatindia.com, along with any related pages, tools, applications and services (together, the "Platform").

The Platform is owned and operated by Heal at India LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008, with LLP Identification Number ACT-2027 and GSTIN 36AASFH9571M1ZD, having its registered office at Plot No. 6, 7 and 8, Kondapur, Serilingampally, Hyderabad, Rangareddy District, Telangana 500084, India ("Heal at India", "we", "us", "our").

By using the Platform, creating an account, listing a Retreat or making a Booking, you agree to these Terms. We advise you to read them carefully and to understand the rights and obligations you have in relation to your use of the Platform.

Please read these Terms together with our Privacy Policy and our Cancellation Policy. All three apply to you.

Electronic agreement: These Terms are an electronic record under the Information Technology Act, 2000 and form a valid and binding contract under Section 10A of that Act. No physical signature is required.

2. Definitions

Guest: Any person who browses, enquires about or books a Retreat through the Platform.

Host: Any retreat centre, ashram, teacher, guru, facilitator or organiser who lists a Retreat on the Platform.

Retreat: Any programme, stay, training, course, consultation or wellness experience listed on the Platform, including add-ons and extras.

Booking: A confirmed reservation for a Retreat made through the Platform.

User: Any Guest, Host or visitor to the Platform.

Content: Any text, photograph, video, review, rating, listing detail, price or other material published on the Platform.

Platform Content: Content created, owned or licensed by Heal at India, including the Platform's design, code, graphics, logos, editorial writing and marks.

Host Agreement: The separate commercial agreement between Heal at India and a Host, covering commission, payouts, listing standards and service levels.

Commission: The fee payable by a Host to Heal at India on a Booking, as set out in the Host Agreement.

Cancellation Policy: The policy published on our Cancellation Policy page, together with the specific policy shown on each listing.

3. Our role

Heal at India is a booking platform. We list Retreats offered by independent third-party Hosts, and we help Guests find and book them.

We are an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 and a marketplace e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020.

We do not own, operate, manage or control any retreat centre. We do not employ, supervise, train or certify any teacher, guru, therapist, physician or facilitator. We do not deliver, host or supervise any Retreat, class, therapy or treatment. We do not provide accommodation, food, transport or medical services.

When you book a Retreat, the contract for the Retreat itself is between you and the Host. Heal at India is not a party to that contract. We facilitate the introduction, the Booking and the payment. The Host is responsible for delivering the Retreat as described.

Every Host is an independent contractor. No Host is our agent, employee, partner or joint venturer and no Host may hold itself out as one.

3.1 What "curated" and "verified" mean on our Platform

We describe our Retreats as curated. We want to be precise about what that does and does not mean.

What we do before a Host goes live:

  1. we review the Host's business registration and identity documents
  2. we ask for, and record, the professional registrations and licences the Host claims
  3. we review the listing's photographs and description for obvious inaccuracy or prohibited health claims
  4. we check that the Host has provided a working contact for guest support

What we do not do:

  1. we do not inspect premises
  2. we do not independently audit or re-verify a practitioner's qualifications with the issuing body
  3. we do not supervise, observe or quality-check any treatment, class or therapy
  4. we do not guarantee the safety, cleanliness, standard or outcome of any Retreat

Where a listing carries a badge such as "Verified Documents", that badge means only that we have received and recorded the documents named on the badge. It is not an endorsement of the Retreat.

4. Eligibility and your account

You must be at least 18 years old and able to enter into a binding contract under the Indian Contract Act, 1872, to book a Retreat or to list one.

If you book on behalf of another person, you confirm that you have their authority to do so and that you have shared these Terms with them. You remain responsible for the Booking.

Minors may attend a Retreat only where the listing expressly permits it and only with a parent or legal guardian who takes full responsibility for them.

When you create an account, please give accurate, current and complete information and keep it updated. Keep your password confidential. Tell us at info@healatindia.com if you suspect unauthorised use. You are responsible for everything done through your account.

We may refuse, suspend or close an account at our discretion, including where we believe information given to us is false, or the account is being misused.

Annual reminder: At least once a year, we will remind you of these Terms, our Privacy Policy and the consequences of not complying with them, as required under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

5. Listings and information on the Platform

Listings are created and controlled by Hosts. Host details, prices, dates, inclusions, photographs, itineraries, qualifications and availability are supplied by the Host and published as supplied, subject to the checks described in Section 3.1.

Please read the listing carefully and ask the Host directly about anything that matters to you before you book.

Photographs and descriptions are indicative. Rooms, meals, facilities and schedules may differ in practice.

Prices, availability, inclusions and terms may change without notice until a Booking is confirmed.

Host information we display: In line with the Consumer Protection (E-Commerce) Rules, 2020, each booking displays the Host's legal name, the principal geographic address of the Retreat, and a contact route for guest queries. Hosts are responsible for the accuracy of this information.

Occasionally a listing may contain an error in price or description. Where the error is obvious and could reasonably have been recognised as one, we or the Host may correct it, or cancel the Booking and refund you in full. This is without prejudice to any right you have under the Consumer Protection Act, 2019.

6. Making a Booking

To book, select your Retreat, dates and options and complete the payment step shown at checkout.

Your Booking is confirmed only when you receive a booking confirmation from us by email. A payment page, a pending status or a reply to an enquiry is not a confirmation.

Your confirmation email sets out your Retreat, dates, inclusions, the amount paid, any balance due and the cancellation policy that applies to your Booking. Please read it and keep it.

Some listings confirm instantly. Others need the Host to accept your request. Where a Host does not accept your request, we will cancel it and refund any amount you have paid.

We may refuse or cancel a Booking where we have reasonable grounds, including suspected fraud, a payment failure, a pricing error, a Host cancellation, or a breach of these Terms.

If we cancel: Where we cancel a confirmed Booking unilaterally, we will not charge you any cancellation fee, and we will refund every amount you have paid to us for that Booking.

6.1 Changing the name on a Booking

You may ask to transfer a Booking to another person. Transfers depend on the Host's policy and availability. Where a transfer is permitted, the new Guest must accept these Terms and provide their own health disclosure under Section 13. A price difference may apply.

6.2 Group and corporate Bookings

Bookings of six (6) or more Guests, and Bookings made by a company, employer or organisation, may be subject to separate terms covering deposits, payment schedules, cancellation windows, rooming and liability. Where separate terms apply, they are issued in writing before the Booking is confirmed and prevail over these Terms to the extent of any conflict.

Where an organisation books on behalf of its people, the organisation is responsible for sharing these Terms and the health guidance in Section 13 with every attending Guest.

7. Prices, taxes and currency

Prices are set by the Host and displayed on the listing.

Unless the listing says otherwise, prices cover the inclusions listed and exclude flights, airport transfers, visas, travel insurance, personal expenses, tips and optional extras.

Total price: Before you pay, we show you a clear breakdown of the total amount payable, including the Retreat price, any applicable taxes and any other charge. There are no hidden charges added after the price you see at checkout.

Currency: You may view prices in a currency of your choice. Converted amounts are indicative only and use publicly available exchange rates that we do not set or verify. The currency in which your payment is charged is shown at checkout. The rate applied by your bank or card issuer may differ from the rate displayed and your issuer may add foreign exchange or cross-border fees. We are not responsible for those differences or fees.

8. Payments

Payments are processed through an authorised payment aggregator regulated by the Reserve Bank of India. We do not store your full card details or your CVV.

How much you pay at the time of booking: This depends on the arrangement we have agreed with that particular Host under the Host Agreement. Two models operate on the Platform:

  • Deposit model — you pay a deposit at the time of booking to confirm your place. The balance is payable to the Host directly, by the date and method shown in your booking confirmation.
  • Full payment model — you pay the full Retreat price at the time of booking. Nothing further is payable to the Host, other than optional extras and anything the listing states is excluded.

Where a balance is payable to the Host directly, paying it is a matter between you and the Host. We are not responsible for collecting it, and we cannot refund an amount that was never paid to us. If you do not pay the balance by the due date, the Host may cancel your Booking under the applicable cancellation policy and your deposit may be forfeited.

Amounts we collect are collected on the Host's behalf and remitted to the Host in line with the Host Agreement. Receipt of your payment by us discharges your payment obligation to the Host to that extent.

If a payment fails, is reversed or is charged back, we may suspend or cancel your Booking and we may recover any resulting loss from the party responsible.

Payments from outside India: Payments received from outside India are processed in accordance with the Foreign Exchange Management Act, 1999 and the rules made under it. Your bank may require information from you to complete an international payment.

9. Booking fees

We do not currently charge Guests a booking fee, service fee or platform fee.

If we introduce a Guest-facing fee in future, we will publish it clearly and give notice under Section 33 before it takes effect. Any fee will be shown in the checkout breakdown before you pay. Bookings confirmed before a fee takes effect are not affected.

Your bank, card issuer or payment provider may charge you separately. Those charges are outside our control.

10. Price parity

Hosts who list on the Platform agree not to advertise the same Retreat at a lower publicly available price elsewhere. This is a condition of listing with us.

If you find a lower publicly available price for the same Host, the same Retreat, the same dates and the same inclusions, write to us at info@healatindia.com and we will take it up with the Host.

Price parity is an arrangement between us and our Hosts. It does not create a right to a price match, a refund or compensation from us.

11. Off-platform bookings

Where a Guest and a Host are introduced through the Platform, both agree not to arrange, take or complete a Booking outside the Platform in order to avoid Commission, fees or these Terms. This includes moving a confirmed enquiry to direct payment, offering a discount conditional on booking directly, or cancelling a Platform Booking and rebooking the same stay directly.

This does not prevent a Guest who already had an independent, pre-existing relationship with a Host from booking with them directly.

Where a Host breaches this Section, we may recover the Commission that would have been payable, suspend or remove the listing, and terminate the Host Agreement.

Booking off-platform also removes your protection: our support, our refund handling and the safeguards in these Terms do not apply to an off-platform arrangement.

12. Cancellations, changes and refunds

Every listing shows the cancellation policy that applies to it. Please read it before you book.

The cancellation policy shown at the time of booking, and repeated in your booking confirmation, governs your Booking. Our Cancellation Policy page explains how our policies work.

Some listings offer free cancellation. Not all do. Check the listing.

Cancellation by the Host: If a Host cancels your Booking, you will receive a refund of the amounts you paid through the Platform. We will help you find an alternative Retreat where we can. We are not liable for any other cost you incur, including flights, visas or separately booked accommodation.

Changes: Requests to change dates, rooms or occupancy depend on the Host's availability and the Host's policy. Price differences may apply.

No-shows and early departure: If you do not arrive, or you leave early, no refund is due unless the listing says otherwise.

How refunds are paid: Refunds are made to the original payment method. We review and approve refunds within 24–48 hours, and the approved refund is initiated immediately — it typically reaches your account in 5–7 bank days. The time it then takes to reach your account depends on your bank or card issuer and is outside our control.

Travel insurance: We recommend comprehensive travel and medical insurance covering cancellation, curtailment, medical treatment and repatriation. Retreat prices do not include insurance.

13. Health, medical and wellness disclaimer

Please read this section carefully.

Retreats listed on the Platform may involve yoga, meditation, breathwork, fasting, dietary restriction, massage, Panchakarma, herbal preparations, physical exertion, heat, cold, silence, altitude, outdoor activity and other practices that carry risk.

Nothing on the Platform is medical advice: Content on the Platform, including listings, blog posts, descriptions and information provided by a Host, is general information only. It is not a diagnosis, a prescription, a treatment plan or a substitute for advice from a registered medical practitioner.

No claim of cure: Neither Heal at India nor any Host offers, promises or guarantees the cure, prevention, treatment or remedy of any disease, disorder or condition. Any outcome described by a Host or by a past Guest is that person's own experience. It is not a representation by us of what you will experience.

Consult your doctor first: Please obtain advice from a qualified medical practitioner before booking or attending a Retreat, and in particular if you:

  • are pregnant, breastfeeding or trying to conceive
  • have a heart, respiratory, neurological, musculoskeletal or metabolic condition
  • have high or low blood pressure, diabetes, epilepsy or a bleeding disorder
  • have a mental health condition, or are receiving psychiatric or psychological treatment
  • take prescription medication of any kind
  • have a recent injury, recent surgery, an allergy or a dietary restriction
  • have a history of substance dependence

Disclose accurately: You must give the Host complete and accurate health information before booking and on arrival. A Host may decline your participation, in whole or in part, on health grounds. If you withhold or misstate health information, you accept the consequences.

Do not stop your treatment: Never stop, reduce or change prescribed medication or medical treatment because of anything you read on the Platform or hear at a Retreat.

Practitioner qualifications: Hosts are responsible for holding, and for the accuracy of, every qualification, registration and licence they claim. Where a Retreat includes an Ayurvedic consultation, Panchakarma or any procedure requiring a registered practitioner, that practitioner is engaged by the Host and not by us. Our role is limited to what is described in Section 3.1. Please ask the Host for registration details and check them before you book.

Emergencies: Many retreat locations are remote and access to hospitals may be limited. Please check what medical support is available before you book.

Your health data: Health information you share is sensitive personal data. We handle it in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. Health information you give directly to a Host is handled by that Host under their own policy.

14. Your responsibilities at a Retreat

By attending a Retreat you accept the risks described in Section 13 and you agree to:

  • take part only within your own physical and mental limits and stop if you feel unwell
  • follow the Host's rules, safety instructions and code of conduct
  • respect the property, the practitioners, other guests, staff and the local community
  • respect the religious, spiritual and cultural context of the practices offered
  • comply with Indian law, including laws on drugs and intoxicants
  • take care of your own belongings

A Host may remove you from a Retreat for unsafe, abusive, disruptive or unlawful behaviour. No refund is due in that case.

Anything you do at a Retreat, and any decision to take part in an activity, is your own choice and your own responsibility.

Raising a problem during your stay: If something is not right with your room, your food, your schedule or your treatment, please raise it with the Host at the time. They are running the Retreat and they are the only ones who can put it right on the spot. If they cannot resolve it, contact us at info@healatindia.com and we will take it up with them.

If it is more serious than that: Where a problem involves your safety, harassment, or conduct you believe crosses a line, you do not have to raise it with the Host first. Write to us directly at info@healatindia.com. We will acknowledge you within 24 hours and will not share your identity with the Host without your agreement, unless the law requires us to. We will look into it, ask the Host for their account of what happened, and act on what we find — which may include suspending or removing the listing under Section 16.2. Where the conduct may be criminal, we will help you report it to the police and will preserve our records of the Booking and the correspondence.

If you are in immediate danger, contact the local police on 100 or 112 first.

Non-discrimination: Hosts must not refuse a Booking, or treat a Guest differently, on the basis of religion, race, caste, sex, gender identity, sexual orientation, place of birth, nationality, disability, marital status or age — except where a genuine, lawful and clearly disclosed restriction applies to the Retreat, such as a women-only retreat, an age minimum for a training programme, or a medical contraindication.

15. Travelling to India

If you are travelling from outside India, you are responsible for:

  • a valid passport, visa and any permit required for your nationality and purpose of travel
  • checking entry requirements for India and for any country you transit through
  • vaccinations, inoculations and health documentation
  • checking travel advisories issued by your own government
  • travel and medical insurance

Visa and entry rules change. Please check again before you travel.

We do not have special knowledge of your entry requirements and we do not advise on them. We accept no liability if you are refused boarding, refused entry, deported or delayed for want of correct documents, or if you cannot attend a Retreat for any of these reasons.

Some Retreats are in remote areas, hill regions or forest zones. Weather, road conditions, permits and local restrictions may affect access.

Registration on arrival: Hosts providing accommodation to foreign nationals are required to report your stay to the Foreigners Regional Registration Office. Please carry your passport and visa and provide them to the Host on arrival.

16. Hosts

If you list a Retreat, this section applies in addition to everything above.

Your commercial terms with us, including Commission, payouts, listing standards and response times, are set out in your Host Agreement. Where your Host Agreement and these Terms conflict, these Terms prevail.

16.1 Your warranties

By listing a Retreat, you confirm that:

  • the information in your listing is accurate, complete and current, and you will update it promptly when things change
  • you hold every registration, licence, approval, permit and insurance required to operate your Retreat and your premises, including, where applicable:
    • registration under the applicable state Clinical Establishments legislation for any clinical or Panchakarma facility
    • a valid FSSAI licence or registration where food is prepared or served
    • fire safety clearance and any building or occupancy approval required locally
    • swimming pool, water quality and adventure activity approvals where relevant
    • a valid public liability insurance policy covering guests on your premises
  • everyone delivering treatment, therapy or instruction on your behalf holds the qualifications and registrations you claim for them, and you will produce evidence on request
  • you comply with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, including constituting an Internal Committee where required
  • you conduct background checks appropriate to the role for anyone working unsupervised with Guests
  • you comply with your obligations to report foreign national guests to the Foreigners Regional Registration Office
  • you own or are licensed to use every photograph and description you upload, and they show what a Guest will actually receive
  • you have the consent of any person appearing in your images
  • you will not state or imply that your Retreat cures, treats, prevents or remedies any disease or condition, and you will comply with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and applicable Ministry of AYUSH advertising norms
  • the price you list with us is not higher than the price you offer for the same Retreat elsewhere
  • you will not solicit or accept Bookings off-platform in breach of Section 11
  • you are responsible for the safety and wellbeing of Guests at your premises
  • you are responsible for your own tax registration, invoicing and filings

16.2 Suspension and delisting

We may remove or suspend a listing immediately, without notice, where we reasonably believe there is a risk to Guest safety, a serious breach of these Terms, unlawful conduct, a fraudulent listing, or a credible allegation under Section 14.

In all other cases, we will give you 24–48 hours' written notice of delisting and set out our reasons, and you may respond before the decision takes effect.

Where a listing is removed, confirmed Bookings already accepted must still be honoured, or cancelled under the applicable cancellation policy with a full refund to the Guest.

16.3 Indemnity and set-off

You are responsible for delivering your Retreat as described. You will indemnify us against any claim arising from your Retreat, your listing, your staff, your premises or your breach of these Terms.

Where we refund a Guest an amount that is properly your responsibility, or incur a chargeback, penalty or cost caused by you, we may set that amount off against any payout due to you.

17. Reviews and content you post

We welcome reviews. Reviews help other Guests choose well.

By posting a review, photograph, video, comment or any other content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, host, store, reproduce, adapt, translate, publish and display it on the Platform and in our marketing, along with the name and location you submit.

You confirm that:

  • the content is yours, or you have the right to post it
  • it is honest and reflects your own experience
  • it does not infringe anyone's copyright, trademark, privacy or publicity rights
  • it contains no personal data of another person posted without their consent
  • it is not defamatory, obscene, abusive, discriminatory, misleading or unlawful
  • it contains no advertising, solicitation or contact details

Reviews may be posted only by Guests who have completed a Booking through the Platform or completed earlier. Hosts must not review their own Retreats, ask anyone to post a false review, offer anything in exchange for a positive review, or review competitors. We remove fake reviews and may close the accounts behind them.

Withdrawing your content: You may ask us to remove your review or the content you posted, at any time, by writing to info@healatindia.com. We will remove it from the Platform within a reasonable period. Copies already used in published marketing material, or retained where the law requires, may remain — we will tell you if that applies.

We may publish, decline, edit for length or remove any review or other content at our discretion. We are not obliged to publish anything.

We do not treat anything you send us as confidential and we owe you no payment for it.

18. Photography, filming and images

Hosts and Guests sometimes photograph or film at a Retreat.

By the Host: A Host who photographs or films a Guest for marketing purposes must obtain that Guest's clear consent first. A Guest may refuse without affecting their Retreat. A Guest may withdraw consent later by writing to the Host.

By Guests: Please respect the privacy of other Guests, staff and the local community. Many Retreats restrict photography in treatment areas, meditation halls and shared spaces. Follow the Host's rules. Do not photograph another Guest without asking.

By us: We use imagery supplied to us by Hosts and content shared with us by Guests under the licence in Section 17. If you appear in an image on the Platform and did not consent to it, write to info@healatindia.com and we will remove it.

19. Marketing communications

We will send you messages relating to your Booking — confirmations, reminders, changes and support replies. These are service messages and you cannot opt out of them while you have an active Booking.

We will send you marketing messages by email, SMS or WhatsApp only where you have opted in. You can withdraw that consent at any time using the unsubscribe link in any marketing email, by replying STOP to a message, or by writing to info@healatindia.com. Withdrawing consent does not affect your Bookings or your service messages.

We handle your contact details in accordance with our Privacy Policy, the Digital Personal Data Protection Act, 2023 and applicable Telecom Regulatory Authority of India regulations.

20. Referrals and affiliates

Where we run a referral or affiliate programme, participation is subject to the separate programme terms published at the time.

You may not earn a referral or affiliate reward on your own Booking, on a Booking made by a household member, or through spam, paid search on our brand name, misleading claims or unauthorised use of our marks. We may withhold or reclaim a reward earned in breach of this Section.

22. Prohibited conduct and content

You must not use the Platform to host, display, upload, publish, transmit or share anything that:

  • belongs to someone else and that you have no right to
  • is defamatory, obscene, paedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, or encourages money laundering or gambling
  • harms a child in any way
  • infringes any patent, trademark, copyright or other proprietary right
  • violates any law in force
  • deceives or misleads about its origin, or communicates information that is patently false or misleading
  • impersonates another person
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to any cognisable offence
  • contains a software virus or any code designed to interrupt, destroy or limit the functionality of any computer resource

You must also not use the Platform for any unlawful purpose, scrape or harvest data from it, collect or track other users' personal information, reproduce or resell any part of it without our written permission, circumvent our security features, interfere with its operation, or send spam or unsolicited commercial messages.

Breach of this section may lead to immediate suspension or removal and we may report the matter to law enforcement.

23. Content removal and takedown

We act on complaints about Content on the Platform.

Standard complaints: Write to our Grievance Officer (Section 26). We acknowledge within 24 hours and resolve within 15 days.

Urgent categories — 24 hours: Where a complaint concerns Content that exposes a person's private area, shows a person in full or partial nudity, shows or depicts a person in a sexual act, or is impersonation including artificially morphed images, we will remove or disable access to it within 24 hours of receiving a valid complaint from the affected person or someone acting on their behalf.

Court or government orders: We will remove or disable access to Content within 36 hours of receiving an order from a court of competent jurisdiction or a notification from an authorised government agency.

Preservation: We retain removed Content and associated records for 180 days for investigation purposes, or longer where the law or a court requires.

Copyright complaints: If you believe Content on the Platform infringes your copyright, write to our Grievance Officer. Please identify the work, tell us where the material sits on the Platform, give us your contact details, and confirm that you believe in good faith that the use is unauthorised and that your notice is accurate. We may remove content and close the accounts of repeat infringers.

24. Intellectual property

The Platform, its design, layout, code, graphics, logos, the Heal at India name and mark, and all Platform Content belong to us or our licensors and are protected by Indian and international intellectual property law.

You may use the Platform for your own personal, non-commercial purposes. You may not copy, modify, distribute, sell, licence, reverse engineer or create derivative works from any part of it without our written permission.

Host listings and Guest reviews remain the property of whoever created them, subject to the licence in Section 17.

Third-party names and marks on the Platform belong to their owners.

25. Third-party links and services

The Platform contains links to third-party websites and uses third-party services such as maps, payment interfaces, currency converters and analytics.

We do not control these and we do not endorse them. They are provided on an "as is" basis. Please read their terms and policies yourself. Any dispute with a third party is between you and them.

Cookies: We use cookies and similar technologies on the Platform. Section 9 of our Privacy Policy explains what we use and how you can manage them.

26. Grievance redressal

We take complaints seriously.

For most issues, please contact our support team first at info@healatindia.com. Most problems are resolved fastest this way.

Grievance Officer: In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020:

We will acknowledge your complaint within 24 hours and give you a ticket number. We will resolve it within 15 days of receipt.

Our Privacy Policy explains your rights in full, including access, correction, erasure, nomination, withdrawal of consent and grievance redressal.

27. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control. These include natural disasters, floods, landslides, earthquakes, extreme weather, fire, epidemic, pandemic, government or regulatory action, curfew, civil unrest, terrorism, war, strike, riot, power failure, failure of internet or telecommunications services, and failure of third-party services.

Where a Retreat cannot go ahead for such a reason, refunds are governed by the listing's cancellation policy and by what the Host is able to offer. Please consider travel insurance.

28. Disclaimers

The Platform is provided on an "as is" and "as available" basis.

We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that any result obtained from using it will be absolutely accurate or reliable.

To the fullest extent permitted by law, we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Subject to the checks described in Section 3.1, we do not warrant the quality, safety, legality or suitability of any Retreat, Host, teacher, therapist, facility or treatment listed on the Platform. Choosing a Retreat is your decision.

We may modify, suspend or withdraw the Platform, or any part of it, at any time.

29. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our own negligence, for fraud, or for anything else that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

Subject to that, and to the fullest extent permitted by law:

We are not liable for any act, omission, negligence, misrepresentation, breach of contract or wrongdoing of any Host, teacher, therapist, guru, facilitator, staff member or other Guest.

We are not liable for any injury, illness, allergic reaction, adverse effect, death, loss, theft or damage occurring at, on the way to, or arising out of any Retreat.

We are not liable for indirect, incidental, special, punitive or consequential loss of any kind, including loss of profit, revenue, savings, data, opportunity or enjoyment, whether or not we were told it was possible.

Where we are found liable to you despite the above, our total aggregate liability for all claims connected with a Booking will not exceed the Commission we received on that Booking.

This cap does not limit your right to a refund. Money you paid to us that is due back to you under Section 6, Section 12 or the applicable cancellation policy is your own money being returned, and it is not subject to this cap.

30. Indemnity

You agree to indemnify and hold harmless Heal at India LLP, its designated partners, partners, officers, employees, agents and service providers against any claim, demand, loss, liability, penalty or expense, including reasonable legal fees, arising out of your use of the Platform, your breach of these Terms or of any applicable law, any Content you post, any Retreat you deliver as a Host, or your violation of any third party's rights.

31. Suspension and termination

You may stop using the Platform at any time and ask us to close your account.

We may suspend or terminate your access, remove your listing or close your account, with or without notice, where we believe you have breached these Terms, where the law requires it, or where we consider it necessary to protect other users or the Platform.

Termination does not affect rights and obligations that arose before it, including confirmed Bookings.

Data after closure: We retain your registration information for 180 days after account closure, or longer where the law requires or a proceeding is pending. Our Privacy Policy explains our retention practice in full.

Sections 11, 13, 17, 18, 23, 24, 26, 28, 29, 30, 32 and 33 survive termination.

32. Resolving disputes

We would like to resolve any disagreement with you directly and quickly. Please raise it with us first under Section 26.

Mediation: If a dispute is not resolved within 30 days of being raised, either of us may propose mediation. Mediation is voluntary and neither of us has to agree to it.

Arbitration: Where both parties agree in writing, a dispute may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Hyderabad, Telangana and the language will be English.

Governing law: These Terms are governed by the laws of India.

Jurisdiction: Subject to the above, the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute arising out of or connected with these Terms or your use of the Platform.

Nothing in this Section affects any right you have as a consumer to approach a consumer commission under the Consumer Protection Act, 2019, including at the place where you reside or work.

33. Changes to these Terms

We may update these Terms from time to time. The current version is always on this page, with the date it was last updated.

Where a change is material, we will give reasonable notice by email or by a notice on the Platform. Continued use after a change takes effect means you accept it.

The Terms in force at the time of your Booking govern that Booking.

34. General

Your data: Our Privacy Policy explains how we handle your personal data, in line with the Digital Personal Data Protection Act, 2023.

Severability: If any provision is held unlawful or unenforceable, it is severed and the rest remains in force.

Waiver: If we do not enforce a right, that is not a waiver of it.

Assignment: You may not assign your rights under these Terms. We may assign ours to a successor or affiliate.

Entire agreement: These Terms, the Privacy Policy, the Cancellation Policy and, for Hosts, the Host Agreement, are the whole agreement between us and replace anything said or written before.

Notices: We will contact you at the email address on your account. Please keep it current.

Headings: Headings are for convenience and do not affect interpretation.

Language: These Terms are in English. Any translation is for convenience only. In case of conflict, the English version prevails.
